Welcome to the Fire Island Ferry Schedules app (“the App”). These Terms of Service (“Terms”) govern your access to and use of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use the App.

Using Our Services

App License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes.

Free and Paid Features

The App is free to download and includes a limited number of ferry schedule searches at no cost.
After reaching the free search limit, you will be prompted to purchase a lifetime subscription to continue using the search functionality.
The exact number of free searches may change at our discretion.

Subscriptions and Payments

Payments for lifetime subscriptions are processed through Apple’s App Store using RevenueCat.
All purchases are final and non-refundable, except as required by applicable law.
For refund requests, please contact Apple’s App Store support directly.

Location Services

The App requests permission to access your location solely to show you the nearest ferry terminal.
You can deny or revoke this permission at any time through your device settings.

Prohibited Uses

You agree not to:

Use the App for any illegal purpose
Attempt to reverse engineer, decompile, or disassemble the App
Remove, circumvent, disable, or interfere with security features of the App
Use automated systems to access the App in a manner that exceeds reasonable use
Redistribute, sell, or lease any part of the App

Intellectual Property

The App and its content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

The App will be available at all times
The App will be error-free
Ferry schedules will always be accurate or up-to-date

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you either through the App or by other means.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the state of New York, without regard to its conflict of law provisions.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the App, us, or third parties, or for any other reason at our sole discretion.
